Insurance companies and others have a duty to exercise good faith in dealing with you. They have an obligation not to take advantage of your lack of knowledge in handling matters they have special expertise in. For instance . . . suppose you had a car wreck and because of it you weren’t thinking straight. They approach you knowing your condition and get you to sign settlement papers. The settlement is outrageous and they know it. In such case where their conduct is egregious you may be able to set the settlement aside and in addition get sizeable bad faith damages. Don’t count on this though. The law requires you to exercise reasonable judgment in handling your affairs and you cannot deal with insurance adjusters lightly. When in doubt you should get legal advice before you put your name on the dotted line. If you signed away your rights and feel you have been taken advantage of you should consult an attorney who has expertise in bad faith claims.
