Cause Unknown

How many serious accidents occur that are marked "cause unknown?" "Many" . . . that might be enlarged to say "most."

Do you know why they are marked "cause unknown"? Because they have not been properly investigated or in most cases not investigated at all.

How can you tell what caused something to happen unless you have competent people checking it out? The most unfortunate thing to happen is to have the evidence disappear. Unfortunately we are, as attorneys, usually contacted after the "horse is out of the barn" and the other side has arranged the disappearance of the critical evidence, and we spend a great deal of time effort and money trying to locate it. This is why it is so very important for seriously injured people to contact an attorney as soon after as possible.

Another important consideration (in addition to having prompt investigation and preserving the evidence) is to have the very best experts involved. Without the right experts you are "whistling in dixie." You have to get them quickly and you have to pay them big bucks.

Armed with the evidence and the experts you can then get reliable opinions that tell you why this terrible incident could have been prevented however that isn’t always the way. We have paid experts a ton of money only to find out in some cases that the product in question really was not defective. That’s the chance we take. So far we have made a lot of clients happy and still managed to pay the bills (knock wood).

People (including attorneys) who are not familiar with this type of litigation ask the question "How can you afford to lay out these huge sums of money when you don’t know what the results of the investigation will be?" The answer has to be and in most cases is two-fold. First of all we still have fair laws that allow small individuals to recover damages against large corporations and second . . most of the time we get a favorable result in the settlement or trial of the case.

So the moral of the story is . . . if you get seriously hurt don’t wait . . . get yourself the right kind of lawyers and get them right away.

Time is of the essence.

Sincerely,

Carl Waldman
