Two recent jury verdicts point out the current viability of mold claims. Because the courts have turned down any possibility of people getting compensated for personal injuries due to mold most attorneys lost interest in mold cases. That is changing. We, the optimist, do believe that science will eventually catch up with the facts and those victims of mold will be paid for physical conditions caused by mold . . . The following mold cases were successful. Through a class action procedure, 32 residents of a newly built housing unit were awarded over a million dollars due to their property damage claims which were caused by mold. The sky is opening up. Also a recovery of $885,000.- was obtained for property damage by a doctor who sued because his $1,000,000. - plus home was uninhabitable due to mold infestation. My advice to you is not to give up if your property has been damaged by mold. Get legal advice. If you can be a part of a class action or if your property damage is substantial enough there is hope for you now. As far as the future is concerned I have difficulty in accepting the current law that does not allow recoveries for personal injuries - this may change so stay posted. Sincerely, |
